What our engagements have involved
Distressed project recovery
Resolution of major delay and disruption claims involving principals, interface contractors and subcontractors, including negotiated settlements securing extension of time awards and financial recovery. Defence of backcharges raised against cost reimbursement entitlements. Insurance recovery under contract works and professional indemnity policies through structured evidence preparation and negotiation with insurers.
Contract restructuring
Negotiation of contract model resets from lump sum to cost-reimbursable, including resets applied retrospectively to contract commencement, on packages where the original allocation of risk had become untenable.
Commercial function establishment and mobilisation
Establishment of commercial functions from inception on multi-billion-dollar projects and alliances. Development of procurement and contract management plans, commercial management plans and governance frameworks. System setup and configuration, including contract and document management systems, progress claim and payment processes, work breakdown and cost coding structures, change and variation registers, and cost at completion forecasting frameworks — built to meet client, joint venture and independent audit requirements.
Project commercial management
End-to-end commercial management of major infrastructure projects, including early identification of cost over-runs, upstream and downstream recovery strategies, integrated multi-discipline procurement to reduce interface risk, and the procurement and administration of substantial subcontract package portfolios.
Client-side procurement leadership
Development of procurement and contracting strategies approved at board and investment committee level, and delivery of full procurement lifecycles through to award across power, roads, design consultancy and framework packages.
Pre-contract and transaction structuring
Commercial and contract risk review of tender documentation, including the identification of positions that will not survive delivery, qualifications and departure schedules. Head contract review and negotiation. Joint venture, teaming and consortium agreements, and the governance frameworks that support them. Negotiation of early contractor involvement and early works agreements, owner-furnished long-lead equipment procurement, and Guaranteed Maximum Price contract structuring, including component pricing arrangements enabling early works to proceed ahead of final agreement.
Dispute prosecution and defence
Prosecution and defence of formal disputes and Security of Payment claims across PPP and design-and-construct portfolios, including secure facilities, hospitals and airports.
